Federal Cyberstalking Law: The John-Paul Miller Case

The case involving John-Paul “JP” Miller, the estranged husband of the late Mica Miller, has received national attention and is the subject of the Netflix documentary Death of the Pastor’s Wife. Miller now faces serious federal criminal charges, bringing increased attention to federal cyberstalking laws and the consequences that can follow allegations involving electronic harassment and surveillance.

Miller has been federally charged with cyberstalking and making false statements to federal investigators. He has pleaded not guilty. The charges are allegations, and he is presumed innocent unless proven guilty beyond a reasonable doubt.

What Are Prosecutors Alleging?

Federal prosecutors allege that Miller engaged in a pattern of harassment and intimidation against Mica Miller that involved electronic communications, tracking devices, interference with her finances and daily activities, and other conduct.

The government alleges that this behavior formed a course of conduct constituting cyberstalking under federal law. These allegations have not yet been proven at trial.

How Serious Is a Federal Cyberstalking Charge?

Federal cyberstalking is prosecuted under 18 U.S.C. § 2261A. The law can apply to certain courses of conduct involving electronic communications, internet services, phones, tracking technology, or other facilities of interstate or foreign commerce when the conduct and intent satisfy the requirements of the federal statute.

A federal cyberstalking conviction can carry significant criminal penalties, including imprisonment and substantial fines.

The Miller case demonstrates that cyberstalking allegations are not limited to threatening posts on social media. Text messages, emails, GPS tracking, smartphones, online accounts, photographs, financial activity, and other electronic evidence may all become important parts of a federal investigation.

False Statements to Federal Investigators

Miller also faces a separate charge of making false statements to federal investigators under 18 U.S.C. § 1001.

This charge highlights an important issue in any federal investigation. Making a materially false statement to federal agents can itself constitute a federal crime, separate from whatever conduct investigators were originally examining.

Anyone who believes they are the subject or target of a federal investigation should understand the potential consequences of speaking with investigators without first obtaining legal advice.

An Indictment Is Not a Conviction

Cases receiving extensive media attention can generate strong public opinions long before a courtroom determines guilt or innocence.

Under our criminal justice system, however, an indictment is an accusation. The government bears the burden of proving every element of a criminal charge beyond a reasonable doubt, and Miller is entitled to the same presumption of innocence as any other criminal defendant.

The case nevertheless serves as an important reminder of how seriously federal authorities may treat allegations involving cyberstalking, electronic surveillance, harassment, and statements made during a federal investigation.
