The DEA and state and local law enforcement organizations are aggressively targeting individuals and organizations who manufacture and distribute fentanyl and other illicit drugs laced with fentanyl.

What is fentanyl?

Fentanyl is an extremely potent synthetic opioid that is estimated to be up to 100 times more potent than morphine and up to 50 times more potent than heroin. Fentanyl’s unique chemical structure and high potency allow it to rapidly affect the central nervous system within seconds of entering the body. Due to its high potential for abuse and addiction, fentanyl is listed as a Schedule II controlled substance under federal law. Possession of fentanyl without a valid prescription is a serious crime under federal and state law that can result in severe criminal penalties.

Why is law enforcement aggressively targeting fentanyl?

Because illicit fentanyl is relatively inexpensive and highly potent, drug traffickers are using it to increase the potency of other illicit drugs such as heroin, cocaine, Xanax, and counterfeit opioid prescription pills. However, illicit fentanyl is produced in clandestine labs lacking standardized controls over quality or potency, and drug traffickers who put fentanyl into their products have no standardized measure of how much fentanyl to use. Users of street drugs laced with fentanyl have no way to know how much fentanyl they may be ingesting – and may not even be aware that they’re ingesting it in the first place. Since even a tiny amount of fentanyl can be lethal, street drugs laced with fentanyl are causing a wave of overdoses and deaths across the United States. In response to this public health crisis, law enforcement is actively targeting fentanyl in an effort to reduce its availability in the illicit drug market.

What should I expect if I’m criminally charged with fentanyl trafficking?

As with any allegation of drug trafficking, criminal charges involving fentanyl must be taken very seriously. Potential penalties can be increased if illicit fentanyl can be traced to overdoses or deaths.
